1. Service Description

MLCostIntel provides ML infrastructure cost analysis and optimization recommendations for AWS environments. We access your AWS Cost and Usage Report data through a read-only IAM role to generate assessments and recommendations.

2. Your Responsibilities

• You are responsible for configuring AWS access via the CloudFormation template we provide
• You are responsible for evaluating and implementing any recommendations we provide
• You are responsible for maintaining the security of your account credentials
• You must have authorization to grant access to the AWS billing data you connect

3. Our Responsibilities

• We will only access data through the read-only permissions you grant
• We will not modify your AWS resources or infrastructure
• We will store and protect your data as described in our Privacy Policy
• We will provide cost analysis and recommendations to the best of our ability

4. Recommendations Disclaimer

Our optimization recommendations are based on analysis of your billing data and industry best practices. However:

• Recommendations are suggestions, not guarantees of savings
• You are responsible for evaluating recommendations against your specific requirements before implementing
• Some recommendations are flagged as "Medium Confidence" — these require validation against your workload requirements
• Insights are informational only and are not actionable recommendations
• We are not responsible for any issues arising from implementing recommendations without proper validation
• Actual savings may vary from estimates

5. Payment

• Free Assessment tier: no payment required
• Implementation and Monitoring tiers: pricing provided via custom proposal based on your assessment results
• Payment terms are specified in individual proposals/agreements

6. Data and Termination

• You can revoke AWS access at any time by deleting the IAM role
• You can request account and data deletion at any time
• We may suspend or terminate accounts that violate these terms
• Upon termination, your data will be deleted within 30 days

7. Limitation of Liability

MLCostIntel provides cost analysis and recommendations on an "as is" basis. We are not liable for:

• Decisions made based on our recommendations
• Changes to AWS pricing that affect savings estimates
• Service interruptions or data processing delays
• Indirect, incidental, or consequential damages

Our total liability is limited to the fees you have paid us in the 12 months preceding any claim.

8. Governing Law

These terms are governed by the laws of the State of Delaware, United States.
